Terms of service (AGB)

English is provided for convenience. Where German and English versions differ, the German text takes precedence for legal interpretation.

§1 Scope

These Terms apply to use of the web application “Immowiser” by consumers and businesses unless individual agreements take precedence. The provider is Immowiser (sole proprietorship); full provider details are in the Imprint. By registering or using the application you accept these Terms.

§2 Subject matter of the service

Immowiser provides deterministic modelling and comparison tools for German property decisions — for rental / buy-to-let and for orienting analyses in owner-occupier use, depending on the selected use type and your inputs.

The product may include integrated calculator modules (e.g. purchase costs, notary split, property tax, landlord tax, repayment schedule, sequencing and provision planning). Depth of analysis, visuals, and verdict layers depend on the plan (Free/Pro/Scale).

The workflow is data-driven (Deals + Documents → Assumptions → calculators → Results → Visuals). Higher tiers may add guided optimisation (e.g. Deal Doctor), trigger dashboards, audit layers, and branded decision dossiers.

Immowiser may show structured decision hints (verdict, drivers, risks, action plan, triggers). These are technical aids, not binding legal or tax recommendations.

A structured funding radar orients against selected KfW routes (124, 300, 297/298, 261, 308, 458, 455-B), BAFA references, and state-bank/municipal layers based on rules and your scenario data.

Document workflows (structured uptake from selectable text, e.g. text-layer PDF or .txt) are plan- and quota-dependent. Image-only or scanned PDFs without a text layer are not automatically processed; manual entry via Assumptions is available in all tiers. OCR for pure images is not part of the service.

Where enabled on the server, optional AI-assisted features may suggest explanatory text or field extraction; deterministic paths take precedence and you must verify all uptake. This is not advice.

The service is expressly not tax, legal, financial, or investment advice. Availability depends on the selected plan.

§2a Manual funding / municipal layer

Immowiser may map a manual local programme layer (e.g. municipal grants, loans, tax bonuses). Users maintain entries and may include them in the model. The software does not perform binding eligibility review and does not guarantee approval or completeness. Conditions can change quickly (budget stops, deadlines, geography, income caps).

§2b Model effect of manual programmes

Where “apply to model” is enabled, grants, loans, and tax bonuses are credited per the simplified product rules to KPIs (e.g. equity at risk, cashflow, debt service). Payout timing may be simplified or user-profiled by plan. This modelling is not a funding promise, individual tax determination, or bank credit decision.

§2c Technical plausibility and conflict checks

The manual programme layer may show technical warnings (codes, stacking, loan volume, potential non-combinability). These support model hygiene only, not legal eligibility. Optional evidence checklists per code are technical indicators, not legal findings.

Rule-based hints may cover typical stacking conflicts, loan loads, and evidence coverage. Results remain technical and non-binding.

§3 Registration and account

You must provide truthful registration data and keep credentials confidential. You are responsible for activity under your account. We may suspend or terminate accounts for abuse, legal requirements, or serious breach of these Terms.

§4 Fees and subscriptions

Paid plans are processed through a payment service provider. Term, notice, and price follow the current product page and checkout. Statutory withdrawal rights for consumers apply where applicable.

§4a Billing intervals (monthly / annual)

Monthly and annual subscriptions include the same product features and quotas for the respective tier (Pro or Scale). Cancellation, renewal, and payment methods follow the selected interval and payment provider. Annual pricing typically reflects about ten monthly instalments; exact amounts are shown at checkout.

Comparison/template limits are plan-dependent (e.g. comparison: Free up to 2, Pro up to 5, Scale up to 15 objects; saved templates per product page).

Mid-cycle upgrades/downgrades are handled by the payment provider per its proration rules; amounts and effective dates are shown at checkout or in the billing area.

§4b Fair use of “unlimited” features

Where a tier shows “unlimited” use (e.g. document extraction on Scale), this means normal human use in property analysis. Bulk automation, resale of access, abusive API use, or disproportionate load may be blocked after notice.

§4c Text from documents (extraction)

Structured uptake requires usable text (e.g. selectable-text PDF or .txt). Pure scans without a text layer are not automatically processed. Quotas and technical limits may apply by plan. We do not guarantee completeness or accuracy of automated recognition; your verified manual inputs prevail. Where AI assistance is enabled, suggestions apply only after your review.

§4d Cancellation and statutory withdrawal

Cancellation via account/billing ends the paid subscription after the already-paid period; services remain usable until then. Separate statutory withdrawal with refund for consumers may apply and is handled via support or the payment provider—not replaced by in-app cancellation alone. VAT is charged as shown on invoices from the payment provider. A complete billing address helps correct tax display.

Whether subscription costs are tax-deductible for you depends on your situation; Immowiser does not provide tax advice—consult advisors and authorities.

§5 Rights of use

We grant a simple, non-transferable right to use the software within the agreed scope. Sharing access, reverse engineering, automated use outside provided interfaces, or reselling accounts/outputs as a service is prohibited unless expressly permitted in writing.

§6 Availability and changes

We aim for high availability but do not guarantee uninterrupted access. We may evolve the product where reasonable and without breaching material duties. Material adverse changes will be communicated in good time.

§7 Liability

Without limiting mandatory law (intent, gross negligence, life/body/health, product liability), the following disclaimer applies by contract. Otherwise liability for slight negligence is limited to typically foreseeable loss.

§8 Disclaimer (contractual)

Immowiser offers deterministic modelling and scenario comparison for German property — for let properties and orienting owner-occupier use. The service is an informational calculation tool only.

No advice: Immowiser does not provide tax, legal, financial, or investment advice. Outputs are mathematical simulations based on your inputs and public rules at calculation time.

Owner-occupier: metrics are for orientation only and do not replace individual tax review.

No warranty: results (IRR, cashflow, tax effects, AfA, subsidies, etc.) are estimates and may diverge materially from reality.

Manual funding/municipal entries are your assumptions; the software does not verify binding eligibility. Technical conflict warnings and checklists are aids only.

Your responsibility: you verify assumptions and obtain professional advice.

Liability cap: to the extent permitted by law, Immowiser and operators disclaim liability for direct, indirect, or consequential loss from use of the tool.

Changing law: tax law, KfW, transfer tax, and energy rules change; we strive to update the model but give no warranty of completeness or timeliness.

§9 Final provisions

German law applies. Venue for merchants and public-law legal entities is the provider’s seat. If a provision is invalid, the remainder stays effective. Full provider details: Imprint.
